    This Agreement sets out the terms under which the Installer may operate under the Spire Renewables Elevate Program and complete heat pump installation works under the Spire Renewables MCS Umbrella Scheme.

    The purpose of the arrangement is to ensure all installations comply with MCS requirements and are eligible for the Boiler Upgrade Scheme (“BUS”) grant where applicable.

    2. Types of Installation Arrangement

    2.1 Installer-Owned Customer

    Where the customer lead is generated by the Installer:

    The Installer shall provide the customer and installation opportunity.

    Spire Renewables shall provide system design support, commissioning, MCS certification and BUS administration services.

    The Installer shall pay Spire Renewables the agreed fee for these services in line with the payment terms set by Spire Renewables.

    Spire Renewables may be required under MCS rules to issue a separate contract directly to the homeowner at nil value for certification and compliance purposes.

    The Installer remains responsible for all agreed installation works and customer-facing installation obligations.

    2.2 Customer Supplied by Spire Renewables

    Where the customer lead is generated or supplied by Spire Renewables:

    The Installer shall act as a subcontractor to Spire Renewables.

    Installation works shall be completed for the agreed fixed fee.

    The Installer must not bypass, circumvent, or attempt to contract directly with any customer introduced by Spire Renewables unless given permission in writing to do so.

    Where Spire Renewables has any involvement in customer acquisition, system design, quotation, or contract structure, the Installer must not remove Spire Renewables from any part of the transaction.

    3. Pre-Installation Responsibilities

    3.1 Responsibilities of Spire Renewables

    Spire Renewables shall be responsible for:

    • Establishing the U-values of the property construction.
    • Obtaining room measurements and property information.
    • Producing the heat loss calculations.

    Correct sizing of:

    • Heat pumps, including that the proposed location of the heat pump complies with manufacturer's requirements
    • Emitters
    • Associated system components

    Providing installation design documentation to the Installer.

    Ensuring all MCS Compliant requirements are adhered to, or the customer is suitably informed that the system design will not comply (for example with undersized radiators in a particular room).

    3.2 Responsibilities of the Installer

    The Installer shall be responsible for:

    • Reviewing and accepting the system design prior to installation.
    • Correctly costing the installation works.

    Verifying that the proposed installation can be completed in accordance with:

    • Current Building Regulations
    • Water Regulations
    • Health & Safety requirements
    • Manufacturer instructions

    Identifying any site-specific issues before works commence.

    Acceptance of the installation works shall confirm the Installer is satisfied that the design can be installed compliantly.

    4. Installation Requirements

    The Installer agrees to:

    • Complete all installation works in a professional and workmanlike manner.

    Install the system in accordance with:

    • Spire Renewables installation guides
    • Manufacturer instructions
    • MCS requirements
    • Relevant regulations and standards

    Complete the installation in a timely manner.

    The period between delivery of the heat pump and commissioning must not exceed two (2) weeks unless otherwise agreed in writing by Spire Renewables.

    Spire Renewables shall inspect the installation quality during commissioning.

    Further details regarding process and compliance requirements are contained within the BUS Offset Process documentation provided by Spire Renewables.

    5. Installation Guidance & Compliance

    Spire Renewables shall provide:

    • Paper installation guides
    • Video installation guidance
    • Compliance procedures and documentation

    Where the Installer follows the supplied guidance, the installation process will align with scheme compliance requirements.

    6. Commissioning

    The Installer must:

    • Agree a commissioning date with Spire Renewables prior to delivery of the heat pump.
    • Ensure the installation is fully ready for commissioning on the agreed date.

    Spire Renewables reserves the right to apply additional charges where:

    • The installation is incomplete at the agreed commissioning date;
    • Commissioning visits are aborted due to installer delays or incomplete works; or
    • Additional attendance is required due to installation defects or non-compliance.

    These charges will be detailed inside the quotation.

    7. Post-Commissioning Responsibilities

    7.1 Installer Responsibilities

    The Installer shall remain responsible for the mechanical workmanship of the installation for a period of two (2) years from commissioning.

    The Installer agrees to:

    • Attend site within three (3) working days where a mechanical workmanship defect is reported.
    • Rectify workmanship defects within a reasonable timeframe.
    • Include the cost of warranty obligations within their installation pricing.

    Mechanical workmanship includes installation-related defects but excludes manufacturer equipment failures.

    7.2 Responsibilities of Spire Renewables

    Spire Renewables shall remain responsible for:

    • Overall system design
    • Product warranties relating to supplied equipment
    • Technical support to the homeowner, and site attendance if required
    • Management of the MCS-compliant two-year workmanship warranty.
    • BUS administration and certification compliance.

    8. Qualification & Insurance Requirements

    The Installer must maintain and provide evidence of:

    • Valid Unvented Hot Water qualification
    • Water Regulations qualification
    • CIS registration
    • Public Liability Insurance with minimum cover of £2,000,000.
    • Professional Indemnity Insurance with minimum cover of £1,000,000

    The Installer shall immediately notify Spire Renewables if any qualification, registration or insurance expires or becomes invalid.

    Where feasible, the Installer should attend:

    • BPEC heat pump training,
    • LCL heat pump training,
    • OFTEC heat pump training, or
    • Alternative recognised low temperature heating system design training.
